Terms of Service

1. Introduction

Welcome to MaintainEase. These Terms of Service ("Terms") govern your access to and use of the MaintainEase platform and services ("Service"). By accessing or using MaintainEase, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the Service.

2. Eligibility

The Service is intended for use by housing society administrators, committee members, Treasurers, Secretaries, and authorised representatives of residential communities in India. By using the Service, you represent that you have the authority to bind your society or organisation to these Terms.

3. Account Responsibility

Societies and administrators are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. You must immediately notify MaintainEase of any unauthorised use of your account. MaintainEase shall not be liable for any loss or damage arising from your failure to comply with this obligation.

4. Data Accuracy & Financial Responsibility

MaintainEase provides tools to assist with accounting and society management. While our automation is designed to be accurate, the ultimate responsibility for verifying financial accuracy, compliance with local bye-laws, and adherence to applicable taxation and accounting laws lies with the society's management committee. MaintainEase is a facilitating tool and is not a licensed accountant, auditor, or financial advisor.

5. Acceptable Use

You agree not to use the Service for any unlawful purpose or in any way that:

  • Violates any applicable Indian law or regulation
  • Infringes upon the rights of any third party
  • Damages, disables, overburdens, or impairs our infrastructure
  • Attempts to gain unauthorised access to any part of the Service
  • Submits false, misleading, or fraudulent data through the platform

6. Intellectual Property

All content, branding, software, and features on the MaintainEase platform are the intellectual property of MaintainEase. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your society's internal purposes. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

7. Limitation of Liability

To the maximum extent permitted under applicable Indian law, MaintainEase shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability for any claim arising out of these Terms shall not exceed the amount you have paid to MaintainEase in the preceding three months. Nothing in these Terms limits liability for fraud or wilful misconduct.

8. Service Availability & Modifications

MaintainEase will make reasonable efforts to keep the Service available. However, we do not guarantee uninterrupted availability. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable prior notice. We may update these Terms periodically; continued use after changes constitutes acceptance.

9. Termination

Either party may terminate the use of the Service with reasonable notice. MaintainEase may suspend or terminate access immediately if these Terms are violated. Upon termination, your right to use the Service ceases. Data deletion will be handled in accordance with our Privacy Policy.

10. Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India). The seat of arbitration shall be in India.

11. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, and the Consumer Protection Act, 2019. Subject to the arbitration clause above, the courts of India shall have exclusive jurisdiction over any disputes arising from these Terms.
